Terms of Service

These Terms of Service ("Terms") govern your access to and use of the Cell Surveys mobile application (the "App") and the website at cellsurveys.com (together, the "Service"), operated by Cell Surveys ("we," "us," or "our"). By downloading, installing, accessing, or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

These Terms incorporate our Privacy Policy by reference. Please read both carefully.

1. Description of the Service

Cell Surveys is a professional signal survey platform that collects cellular signal strength, WiFi network, Bluetooth device, ambient sound level, ambient light level, location, and related device data (with explicit consent) to generate real-world mobile coverage and environmental heatmaps and connectivity insights. These insights help DAS integrators, building owners, facility managers, and network operators improve connectivity. The Service also includes our website for information and contact purposes.

The App may collect data while running in the foreground or background (via a persistent notification) when you have granted the necessary permissions and consent. You may stop background collection at any time by revoking consent in the App or stopping the survey service.

We do not collect personally identifiable information from the App unless voluntarily submitted (e.g., via contact form or sign-in). All contributed survey data is anonymized before aggregation or sharing. Use of the Service is at your own risk.

2. Eligibility and User Accounts

You must be at least 18 years old (or the age of majority in your jurisdiction) to use the Service. By using it, you represent that you meet this requirement and have the legal capacity to agree to these Terms.

You must sign in with a Google account or email to use the App. By signing in, you agree to provide accurate information and not share your credentials. You may delete your account at any time through the App's Settings or by contacting us via our contact form. Upon account deletion, all associated personal data will be deleted within 30 days, though anonymized, aggregated data may be retained.

3. User-Contributed Data and License Grant

By enabling data collection in the App and granting permissions (e.g., location, cellular, WiFi, Bluetooth, microphone for sound levels, light sensor, and other device sensors), you voluntarily contribute anonymized measurements. You grant us a worldwide, royalty-free, perpetual, irrevocable, non-exclusive license to use, process, aggregate, anonymize, store, and share that data for the purposes described in our Privacy Policy (e.g., creating coverage heatmaps, connectivity analytics, and sharing aggregated insights with partners).

Microphone use: If you enable sound-level collection, the App accesses your device's microphone to measure ambient decibel levels only. No audio, voice, or speech is recorded, stored, or transmitted.

You retain no ownership or rights to the aggregated/anonymized datasets. You agree not to contribute data that violates any law or third-party rights.

4. Fleets (Group Data Sharing)

The App allows you to create or join a "fleet"—a private group of users who pool their survey data for shared heatmap insights. By joining a fleet:

  • Your survey data is aggregated with other fleet members' data and made visible to the group as heatmap overlays;
  • Individual members' raw data is not identifiable to other members;
  • You may leave a fleet at any time, which stops future data sharing with that group;
  • Fleet creators are responsible for sharing the fleet token and PIN only with intended members.

We are not responsible for how fleet creators distribute access credentials or for any misuse by fleet members.

5. Acceptable Use

You agree to use the Service only for lawful purposes and in compliance with these Terms. You must not:

  • Use automated tools (bots, scrapers, etc.) to access or overload the Service;
  • Attempt to reverse-engineer, decompile, disassemble, or circumvent any part of the App/Service;
  • Interfere with or disrupt the Service or others' use;
  • Upload or transmit viruses, malware, or harmful code;
  • Harvest or collect data about other users;
  • Resell, sublicense, or commercially exploit the Service or derived data without our written permission;
  • Use the Service in violation of any applicable law or regulation.

We may suspend, terminate, or restrict your access at any time if we believe you have violated these Terms or for any other reason, without notice or liability.

6. Intellectual Property

The Service, including its software, design, text, graphics, heatmaps, branding, and any aggregated data outputs, is owned by us or our licensors and protected by copyright, trademark, and other laws. You are granted a limited, non-transferable, revocable license to use the Service for personal, non-commercial purposes only. You may not copy, modify, distribute, sell, or create derivative works without our prior written consent.

7. Disclaimers and No Warranties

The Service is provided "as is" and "as available" without warranties of any kind, express or implied, including but not limited to merchantability, fitness for a particular purpose, accuracy, reliability, or non-infringement. We do not warrant that the Service will be uninterrupted, error-free, secure, or free of viruses. Coverage heatmaps are based on survey data and may not reflect real-time or complete network performance. You use the Service at your own risk.

8. Limitation of Liability

To the fullest extent permitted by law, we (and our affiliates, officers, directors, employees, agents) shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or loss of profits, data, use, goodwill, or other intangible losses arising from your use of (or inability to use) the Service, even if advised of the possibility.

Our total aggregate liability to you for any claims shall not exceed the greater of (a) the amount you paid us (if any) in the 12 months preceding the claim, or (b) US$100. Some jurisdictions do not allow limitations/exclusions of liability; in those cases, liability is limited to the maximum extent permitted by law.

9. Indemnification

You agree to indemnify, defend, and hold harmless Cell Surveys and our affiliates, officers, directors, employees, and agents from any claims, liabilities, damages, losses, costs, or expenses (including reasonable attorneys' fees) arising from your use of the Service, violation of these Terms, or violation of any third-party rights or laws.

10. Changes to the Service or Terms

We may modify, suspend, or discontinue the Service (or any part) at any time without notice or liability. We may update these Terms; continued use after changes constitutes acceptance. We will post updates here and update the "Last updated" date. For material changes, we may provide additional notice (e.g., in-app) where feasible.

11. Governing Law and Dispute Resolution

These Terms are governed by the laws of the State of Arizona, USA, without regard to conflict of laws principles. Any disputes arising from these Terms or the Service shall be resolved exclusively in the state or federal courts located in Maricopa County, Arizona. You agree to submit to the personal jurisdiction of those courts.

To the extent permitted by law, you waive any right to a jury trial and agree that claims must be brought individually (no class actions).

12. General Provisions

These Terms constitute the entire agreement between you and us. If any provision is held invalid, the remainder remains in effect. Our failure to enforce any right does not waive it. You may not assign these Terms without our consent; we may assign them freely. Headings are for convenience only.
